HOA insurance and multifamily insurance cover similar buildings but answer to different owners. Here is how that shapes where a captive fits in your portfolio.

HOA insurance and multifamily insurance cover similar buildings but answer to different owners. Here is how that shapes where a captive fits in your portfolio.

HOA Insurance vs. a Multifamily Captive: Key Structural Differences

A condo building and an apartment building can look identical from the street. Their insurance works very differently. The difference comes down to one question: who owns what?

If you manage both association communities and rental properties, or you are deciding whether HOA insurance is a fair comparison to a multifamily captive, here is how the structures differ and where a captive fits.

The core difference: one owner or many

In a multifamily property, one owner holds everything. A single LLC, fund, REIT or individual owns the building and every unit. One owner buys the habitational insurance, pays the premium and handles the claims. That same owner can decide to put that premium into a captive and receive what isn’t spent on claims.

In an HOA or condo association, ownership is split by design. Each homeowner owns a unit. The association, run by a board of homeowners, insures the common areas and usually the building structure. Each owner insures their own unit separately. Decisions run through the board and the governing documents, and any savings flow back through association budgets and dues.

What each side insures

The HOA master policy

The master policy covers what the association owns, usually common areas and the building structure. Depending on the governing documents, it may be written as bare walls, single entity or all-in coverage, which changes how much of each unit’s interior it includes. The board chooses the carrier and terms, usually with a broker.

Unit owner HO-6 policies

Each unit owner carries an HO-6 policy for their interior finishes, belongings and personal liability. Those are individual homeowners policies bought from any carrier.

Multifamily habitational insurance

A rental property’s program covers the whole building, every unit, the common areas and the owner’s general liability. Residents carry renters or resident liability insurance for their own liability and belongings.

Why the structure decides where a captive fits

A captive works best when one decision-maker controls the premium and receives the results. That describes a rental owner. In an association, the premium belongs to a collective of homeowners, so any alternative structure needs board approval, a review of the governing documents and agreement on how results are shared. That is a governance question, not a judgment about how associations are run.

Where mixed portfolios have options

Rental communities you own

These are full candidates for a captive across the resident, owner and operator layers.

Build-to-rent communities with HOA covenants

Some build-to-rent communities use HOA covenants for community rules while one owner still owns every home. When one owner holds the homes, that owner decides how the property is insured. See captive insurance for build-to-rent communities.

Associations you manage but don’t own

Your management company’s own lines, like workers’ compensation and professional liability, belong to you, not the association. Those can sit in a captive no matter how each association insures its buildings. We cover that in captive insurance for property management companies.

How Insur3Tech works with mixed portfolios

Insur3Tech’s captive is built for every portfolio size and asset type. There is no minimum premium and no unit minimum; portfolios as small as 4 doors can join. There are no holdout periods. The entire program is reinsured, so you carry no downside risk. What isn’t spent on claims comes back to you.
