How Social Inflation Is Changing Multifamily Liability Underwriting in 2026
Your liability renewal went up again, and your claims did not. Underwriters have a name for a big part of the reason: social inflation.
Social inflation is the insurance industry’s term for liability claim costs rising faster than economic inflation can explain. It comes from the legal and social environment around claims, not from more slip-and-falls. For multifamily owners it is now one of the main forces behind general liability (GL) and umbrella pricing. Here is what it is, where it shows up in apartments, and how carriers are changing multifamily liability underwriting because of it.
What social inflation actually is
Swiss Re Institute found U.S. liability claims grew 57% over a decade and attributes much of that to social inflation. The usual drivers:
Nuclear verdicts. Jury awards of $10 million or more. Marathon Strategies counted a record 190 of them against corporate defendants in 2025, across all industries.
Third-party litigation funding. Outside investors finance lawsuits in exchange for a share of the recovery, which can keep cases going longer.
Plaintiff bar strategy. Swiss Re points to data analytics, digital advertising and psychology-based jury tactics.
Jury sentiment. Growing mistrust of large companies, including large landlords.
We covered the verdict side in depth in how nuclear verdict trends are driving liability insurance costs.
Where multifamily feels it
Negligent security
When a crime happens on a property, the claim often argues the owner should have prevented it. The Baldwin Group reports rising frequency and severity of weapon and assault-related claims, including at properties with cameras and gated access.
Premises claims
Slip-and-fall and other premises claims have always been part of owning apartments. What has changed is what they cost to resolve. Baldwin says severity keeps rising.
Habitability and maintenance
Mold, fire and maintenance disputes have produced large awards in recent years, as Insurance Journal reported on an Advocate Technologies analysis that found multifamily liability pricing is tracking lawsuits.
How carriers are changing multifamily liability underwriting
Higher rates. ApartmentInsured’s 2026 mid-year report puts GL increases at 3% to 8% nationally and 10% to 20% in high-litigation states, with umbrella up 8% to 15%.
Smaller limits per carrier. The same report says many umbrella carriers have cut per-risk limits, so you may need several carriers to build the tower you had.
Bigger retentions. Baldwin says self-insured retentions of $25,000 to $100,000 are now common for larger portfolios and those with adverse loss history.
Harder questions. Expect more questions on security, lighting, access control, incident response and fair housing training.
Venue exits. Some carriers have pulled back from multifamily GL in the toughest litigation states.
What owners can do
Social inflation is not a cycle you can wait out. Your response works best on two tracks.
Document everything
Security assessments, maintenance logs, incident reports and training records reduce real risk, and they are your defense file if a claim turns into a lawsuit. They also give your broker something concrete to put in front of underwriters.
Change who benefits from your premium
You can’t control a jury. You can control who owns your insurance results. In a captive, the premium you pay goes into a company you co-own, and what isn’t spent on claims comes back to you instead of going to a carrier’s shareholders.
Insur3Tech’s captive has no minimum premium, no unit minimum (portfolios as small as 4 doors can join) and no holdout periods. The entire program is reinsured, so you carry no downside risk, including the large verdicts social inflation produces. If you want to see how that protection works, read our plain-English guide to reinsurance and stop-loss.
Talk to your broker and lender before you change any limits they require. A captive changes who owns the results. It does not mean you should carry less coverage.
